1. Acceptance of these Terms

These Terms of Service (the “Terms”) are a binding agreement between you and StoreLooks (“StoreLooks”, “we”, “us”, or “our”) governing your access to and use of the website at https://storelooks.com, its subdomains, and every page, feature, API, email, and service we offer through them (together, the “Service”).

By accessing or using the Service in any way, including by browsing a single page, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service. If you use the Service on behalf of a company or another person, you represent that you have authority to bind them, and “you” includes them.

These Terms include a binding individual arbitration agreement and a class action waiver (Section 15). They affect how disputes are resolved. Please read them.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service you represent that you are at least 18, that you are not barred from using the Service under any applicable law, and that you have not previously been suspended or removed from the Service. The Service is not directed to children, and we do not knowingly collect personal information from anyone under 16.

3. What the Service is

StoreLooks is an independent design reference: a catalog of screenshots, captures, and metadata describing the public websites, product pages, and advertisements of third-party consumer brands, with tools to browse, search, save, and arrange them. The Service is provided for informational, educational, commentary, and research purposes.

StoreLooks is not affiliated with, endorsed by, or sponsored by any brand, storefront, or advertiser shown on the Service. All trademarks, logos, product names, photographs, copy, and other material captured from third-party websites and advertisements belong to their respective owners and appear for identification and reference only. Captures are point-in-time snapshots; the live sites may differ, and we make no representation that any capture is current, complete, or accurate.

We may add, change, suspend, limit, or remove any part of the Service, any content, or any feature at any time, for any reason, with or without notice, and we have no obligation to maintain, support, update, or keep available any part of the Service.

4. Accounts

Some features require an account. Account creation and sign-in are handled by our authentication provider. You are responsible for everything that happens under your account, for keeping your credentials confidential, and for providing accurate information. We may refuse, suspend, or terminate any account at any time, for any or no reason, without liability to you.

Anonymous use is tracked with a browser identifier so that saves and canvases you create before signing up can be attached to your account later. Clearing your cookies severs that link.

5. Email and communications consent

By creating an account, or by confirming a subscription through the link we email you, you expressly consent to receive marketing, promotional, product, and transactional email from StoreLooks at that address, including newsletters about new storefronts, ads, features, offers, and partner promotions, at whatever frequency we choose. This consent is a condition of using those features. Entering your address in a subscribe form sends only the confirmation email.

You can unsubscribe from marketing email at any time using the link in any message or by emailing storelooksapp@gmail.com. Unsubscribing does not stop transactional or account-related messages, which we may send as long as you hold an account. We are not responsible for messages that are delayed, filtered, or not delivered by your email provider.

6. Acceptable use

You agree that you will not, and will not help anyone else to:

  • scrape, crawl, spider, harvest, index, mirror, bulk-download, or otherwise extract content or data from the Service by automated means, or use any content from the Service to train, fine-tune, evaluate, or improve a machine-learning or AI model, without our prior written permission;
  • resell, sublicense, redistribute, frame, or commercially exploit the Service or its content, or present it as your own;
  • circumvent, disable, or interfere with any access control, rate limit, sign-up gate, paywall, or security feature of the Service;
  • probe, scan, test, or attack the Service, overload it, or interfere with any other user’s access;
  • reverse engineer, decompile, or attempt to derive source code from the Service, except where the law expressly forbids this restriction;
  • upload or submit anything that is unlawful, infringing, defamatory, obscene, malicious, deceptive, or that you do not have the right to share;
  • impersonate any person or entity, misrepresent your affiliation, or submit false or misleading brand requests;
  • use the Service for any unlawful purpose or in violation of these Terms.

We may investigate suspected violations, remove content, throttle or block access, and suspend or terminate accounts in our sole discretion, and we may cooperate with law enforcement and rights holders.

7. Intellectual property and license

The Service, including its design, code, compilation, selection, arrangement, organization, metadata, palettes, tags, text, and all other original material we create (the “StoreLooks Content”), is owned by StoreLooks or its licensors and is protected by copyright, trademark, database, and other laws. TheStoreLooks name, wordmark, and logo are our trademarks; you may not use them without our written permission.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access the Service and view its content in your browser for your own reference. No other right or license is granted, by implication or otherwise. All rights not expressly granted are reserved.

Third-party content shown on the Service (including screenshots of third-party websites and ad creative) remains the property of its owners. We display it under the doctrines of fair use, fair dealing, and comparable exceptions for commentary, criticism, research, and reference, and pursuant to the rights holders’ public publication of it. Your use of any third-party content is at your own risk and subject to the rights holder’s terms.

8. Your submissions and uploads

The Service lets you submit brand and page requests, create canvases, upload images, and provide feedback (together, “Submissions”). You keep whatever rights you have in your Submissions. In exchange for the Service, you grant StoreLooks a worldwide, perpetual, irrevocable, royalty-free, fully paid, transferable, and sublicensable license to host, store, reproduce, modify, adapt, publish, display, distribute, and otherwise use your Submissions in connection with operating, improving, promoting, and developing the Service and our business, in any media now known or later developed, without attribution or compensation.

You represent and warrant that you own or have all necessary rights to your Submissions, that they do not infringe or violate anyone else’s rights or any law, and that they contain no personal information about anyone other than you unless you have their permission. Feedback and suggestions may be used freely by us without any obligation to you.

We may review, screen, refuse, edit, or remove any Submission at any time for any reason, but we have no obligation to do so, and we are not responsible for any Submission or for any loss of Submissions. Canvases are private to your account by default; you are responsible for anything you choose to share.

9. Copyright and takedown requests

We respect intellectual property rights and respond to notices that comply with the Digital Millennium Copyright Act (DMCA) and similar laws. If you believe content on the Service infringes your copyright or trademark, send a notice to storelooksapp@gmail.com with: (1) your physical or electronic signature; (2) identification of the work you claim is infringed; (3) the URL of the material on the Service; (4) your contact details; (5) a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law; and (6) a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner.

We may remove or disable access to material in response to a notice without liability to anyone, may forward notices to the affected party, and may terminate repeat infringers. If you believe material was removed by mistake, you may send a counter-notice with the information required by 17 U.S.C. §512(g)(3). Knowingly false notices may expose you to liability under 17 U.S.C. §512(f).

Brand owners who prefer not to appear on the Service may request removal of their listing by emailing storelooksapp@gmail.com; we handle such requests at our discretion and without admission of any obligation.

10. Third-party sites, ads, and services

The Service links to and depicts third-party websites, storefronts, products, and advertisements, and relies on third-party services (hosting, authentication, analytics, advertising, email delivery). We do not control and are not responsible for any third-party site, service, product, offer, advertisement, price, availability, privacy practice, or content, and we do not endorse any of them. Any transaction, interaction, or dispute you have with a third party is solely between you and that third party.

Prices, promotions, and claims shown in captured ads and pages were made by the advertiser at the time of capture and may be expired, inaccurate, or unavailable. Nothing on the Service is an offer by StoreLooks to sell anything.

11. Fees and paid features

The Service is currently free to browse. We may introduce paid plans, features, or limits at any time. If you purchase a paid plan, the price, billing cycle, renewal, and cancellation terms shown at checkout apply, fees are non-refundable except where the law requires otherwise, and we may change prices for future billing periods with notice. Taxes are your responsibility.

12. Privacy, cookies, and advertising

Our Privacy Policy explains what we collect and how we use it. In short: we use cookies, local storage, analytics tools, and advertising pixels (including the Meta Pixel) to measure use of the Service and to advertise to you and people like you across other sites and platforms, and we share data with those providers for that purpose. By using the Service you consent to that collection and use, to the extent permitted by the law that applies to you. Where the law requires opt-in consent for non-essential cookies, we will ask before setting them.

13. Disclaimers

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS, AND WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, STORELOOKS AND ITS OWNERS, OPERATORS, CONTRIBUTORS, LICENSORS, AND SERVICE PROVIDERS (THE “STORELOOKS PARTIES”) DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; THAT ANY CONTENT (INCLUDING CAPTURES, PALETTES, TAGS, DATES, SEARCH RESULTS, OR SIMILARITY SUGGESTIONS) IS ACCURATE, COMPLETE, CURRENT, OR LAWFUL TO USE FOR YOUR PURPOSE; THAT DEFECTS WILL BE CORRECTED; OR THAT YOUR DATA, LIKES, CANVASES, OR UPLOADS WILL BE PRESERVED. YOU USE THE SERVICE AND RELY ON ITS CONTENT ENTIRELY AT YOUR OWN RISK. NO ADVICE OR INFORMATION OBTAINED FROM US OR THROUGH THE SERVICE CREATES ANY WARRANTY. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE STORELOOKS PARTIES BE LIABLE TO YOU OR ANYONE ELSE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, OR USE, OR FOR THE COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, STATUTE, OR OTHERWISE), EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF THE STORELOOKS PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US $50.

These limitations are fundamental elements of the bargain between you and us; the Service would not be offered without them. They apply even if a remedy fails of its essential purpose. They do not limit liability that cannot be limited under applicable law, such as liability for fraud, willful misconduct, or gross negligence where the law prohibits its exclusion, and they do not affect statutory consumer rights that cannot be waived.

15. Indemnification

You agree to defend, indemnify, and hold harmless the StoreLooks Parties from and against any claims, demands, losses, liabilities, damages, judgments, settlements, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use or misuse of the Service; (b) your Submissions; (c) your violation of these Terms or any law; (d) your violation of any third-party right, including intellectual property, privacy, or publicity rights; or (e) any dispute between you and a third party. We may assume the exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate with us.

16. Dispute resolution: binding arbitration and class action waiver

PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU TO ARBITRATE DISPUTES INDIVIDUALLY AND LIMITS THE WAYS YOU CAN SEEK RELIEF.

Informal resolution first. Before starting any arbitration or lawsuit, you agree to send a written description of the dispute, your contact details, and the relief you seek to storelooksapp@gmail.com, and to negotiate in good faith for at least 60 days. Most concerns can be resolved this way. Any statute of limitations is tolled during this period.

Agreement to arbitrate. Except as stated below, any dispute, claim, or controversy arising out of or relating to these Terms, the Privacy Policy, or the Service (including their formation, validity, scope, enforceability, breach, or termination, and whether a dispute is arbitrable) will be resolved exclusively by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, and, where applicable, its Mass Arbitration Supplementary Rules. The Federal Arbitration Act governs this section. The arbitrator, not any court, decides all threshold questions, including arbitrability. Arbitration will be conducted by a single arbitrator, by document submission, telephone, or video where the rules allow, otherwise in Delaware or in the county where you live. The arbitrator may award the same individual relief a court could, and must follow these Terms as a court would. Judgment on the award may be entered in any court of competent jurisdiction. Each party bears its own attorneys’ fees unless the arbitrator awards them under applicable law or the rules; we will pay arbitration filing and arbitrator fees the rules assign to us.

Class action and jury waiver. YOU AND STORELOOKS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL PROCEEDING. The arbitrator may not consolidate more than one person’s claims or preside over any form of class or representative proceeding. YOU AND STORELOOKS WAIVE ANY RIGHT TO A JURY TRIAL. If this class action waiver is found unenforceable as to a particular claim, that claim must proceed in court, not in arbitration, and the rest of this section still applies.

Mass filings. If 25 or more similar arbitration demands are filed by or with the help of the same or coordinated counsel, the parties agree they will be administered in batches under the AAA Mass Arbitration Supplementary Rules, with a bellwether process and a single filing fee per batch, and that the claims not in a current batch are stayed until it concludes.

Exceptions. Either party may bring an individual claim in small claims court if it qualifies, and either party may seek injunctive or other equitable relief in court to protect intellectual property or to stop unauthorized use of the Service.

30-day opt-out. You may reject this arbitration agreement by emailing storelooksapp@gmail.com within 30 days after you first accept these Terms, with your name, the email you use with the Service, and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.

Venue for court proceedings. For any dispute not subject to arbitration, you agree to the exclusive jurisdiction and venue of the state and federal courts located in Delaware, and you waive any objection to that venue.

17. Governing law

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Delaware and the federal laws of the United States, without regard to conflict of law rules, except that the Federal Arbitration Act governs the arbitration agreement. The United Nations Convention on Contracts for the International Sale of Goods does not apply. If you access the Service from outside the United States, you do so on your own initiative and are responsible for compliance with local law.

18. Time limit on claims

To the extent permitted by law, any claim arising out of or relating to these Terms or the Service must be filed within one year after the claim arose, or it is permanently barred.

19. Termination

You may stop using the Service at any time and may delete your account through your account settings or by emailing storelooksapp@gmail.com. We may suspend or terminate your access to all or part of the Service at any time, with or without cause, with or without notice, and without liability. On termination, your license ends immediately; Sections 6 through 20 survive.

20. Changes to these Terms

We may revise these Terms at any time by posting the updated version at https://storelooks.com/terms and updating the effective date. Material changes may also be announced by email or a notice on the Service. Changes take effect when posted unless stated otherwise. Your continued use of the Service after a change means you accept the revised Terms. If you do not agree, stop using the Service. Changes to the arbitration section do not apply to disputes for which the informal resolution process was started before the change.

21. General terms

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Service and supersede any prior agreements.
  • Severability. If any provision is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the rest of the Terms remain in effect.
  • No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
  • Assignment. You may not assign or transfer these Terms or your account. We may assign them freely, including in a merger, acquisition, or sale of assets.
  • Force majeure. We are not liable for any delay or failure caused by events beyond our reasonable control.
  • No third-party beneficiaries. Except for the StoreLooks Parties, who may enforce the disclaimers, limitations, and indemnity, these Terms create no third-party rights.
  • Electronic communications. You agree that we may communicate with you electronically and that electronic notices satisfy any legal requirement that a communication be in writing.
  • Export and sanctions. You represent that you are not located in, and are not a national of, a country subject to comprehensive US sanctions, and are not on any US restricted-party list.
  • Headings and interpretation. Headings are for convenience only. “Including” means “including without limitation”.
